Senator Jeff Sessions vs Sonia Sotomayor

Well it didn’t take long for the fireworks to start.  Sen. Sessions went after the judge on the Ricci decision, and how she applies her back ground and empathy to cases she presides over.  There was a lot of good back-and-forth, response- rebuttal action.  I do think that Senator Sessions managed to get Sotomayor to backtrack on her initial answer about her Latina heritage, and the application of such to the law.

A few snippets:

She said she was simply trying to colorfully layer her comments on top of former Justice Sandra Day O’Connor’s statement that wise old man and wise old woman would reach the same results in a case.

“I was trying to play on her words. My play fell flat. It was bad,” Sotomayor said.

Sessions also told Sotomayor that he felt her statements Tuesday were “quite inconsistent” with her past statements about the role a judge’s background plays in making decisions.

“You do believe that you’re background will affect the result in a case, and that is troubling me,” Sessions said.

“My record shows that at no point in time have I permitted my personal views and sympathies to affect the outcome of a case,” Sotomayor replied.
